These Terms and Conditions ("Terms") govern your use of the website www.smartmonkeygolf.com (the "Website") and all purchases made through it. Please read these Terms carefully before using the Website or placing an order.

1. About Us

The Website is operated by Smart Monkey Golf Ltd ("we", "us" or "our"), a company registered in England and Wales with company registration number 16959019. Our registered office is York House, York Lane, Brinkworth, Chippenham, England, SN15 5AN.

2. These Terms

By accessing or using the Website, or by placing an order with us, you agree to be bound by these Terms. If you do not agree, you must not use the Website or place orders.

We may update these Terms from time to time. The updated Terms will be posted on the Website with a new "Last updated" date. The Terms in force when you place an order apply to that order.

3. Use of the Website

You must be at least 18 years old to use the Website and place orders.

You agree to use the Website only for lawful purposes and in accordance with these Terms. You must not misuse the Website (for example by introducing viruses, hacking, or attempting unauthorised access).

All content on the Website (including text, images, logos, and product descriptions) is owned by or licensed to Smart Monkey Golf Ltd and protected by copyright and other intellectual property laws. You may not reproduce, distribute, or commercially exploit it without our prior written consent.

4. Ordering and Contract Formation

All orders are subject to acceptance by us and availability of stock. We may refuse or cancel an order (for example because of an error in pricing or product description, suspected fraud, or a stock issue). If we cancel after payment, we will refund you in full.

By placing an order, you make an offer to buy the goods. A contract between you and us is formed when we send you an order confirmation email.

Prices are shown inclusive of VAT (where applicable) but exclusive of delivery charges, which are added at checkout. We may correct pricing errors before dispatch, and will contact you before going ahead if the price changes.

5. Personalised Stance Mirrors and Your Measurements

Our stance mirrors are made to order. A base + top mirror is made to the measurements you send us after ordering, and your base is printed with the name you give us at checkout.

  • After you order a base + top mirror, we send you a measuring map and a link to send us your measurements. We make your mirror once we receive them.
  • Please take your measurements carefully, following our measuring guide. We check every set before anything is made, and if something looks wrong we will contact you rather than make it. The mirror is made to the figures you send, so you are responsible for their accuracy.
  • A top mirror bought on its own needs no measurements and is not personalised.

6. Payment

We accept payment by credit or debit card and other methods shown at checkout, processed securely by third-party payment providers.

Payment must be made in full at the time of ordering. We will not dispatch goods until payment is confirmed.

If you pay by credit or debit card, you confirm that the card is yours or that you have the owner's permission to use it.

7. Dispatch and Delivery

  • Base + top mirrors: dispatched within 72 hours of us receiving your measurements.
  • Top mirrors on their own, the Aim Bar and other items: dispatched within 72 hours of your order.

Delivery charges and estimated delivery times after dispatch are set out in our Shipping Policy. Delivery times are estimates and are not guaranteed unless we have expressly agreed otherwise.

Risk in the goods passes to you on delivery. Ownership passes to you when we receive full payment.

If goods arrive damaged, please tell us within 48 hours of delivery. If your order has not arrived, please tell us within 14 days of the expected delivery date.

8. Your Right to Cancel

As a consumer in the UK you normally have a right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel a distance contract within 14 days without giving a reason. How this applies to our products:

  • Base + top mirrors, before you send your measurements: you can cancel for a full refund, including delivery. Nothing has been made yet.
  • Base + top mirrors, once you have sent your measurements: the mirror is made to your specification and is clearly personalised, so the 14-day cancellation right does not apply (regulation 28(1)(b) of the Consumer Contracts Regulations 2013). From this point the order cannot be cancelled or returned for a change of mind. The base and top are made as one personalised set, so the top cannot be returned separately from the base.
  • Top mirrors bought on their own, the Aim Bar and other non-personalised items: you can cancel and return them within 14 days of delivery for any reason, provided they are unused and in their original condition and packaging.

To cancel, email enquiries@smartmonkeygolf.com with your order number. How returns and refunds work is set out in our Returns and Refund Policy, which forms part of these Terms.

9. Your Statutory Rights (Faulty or Misdescribed Goods)

Nothing in these Terms affects your rights under the Consumer Rights Act 2015. Every item we sell, personalised or not, must be:

  • Of satisfactory quality
  • Fit for purpose
  • As described

If goods are faulty, misdescribed, or not made to the measurements you sent us, you may be entitled to a repair, replacement, price reduction, or full refund, depending on the circumstances and how long you have had them. Please contact us as soon as possible with photos and details of the problem.

10. Returns and Refunds

Our Returns and Refund Policy explains how to return an eligible item and how refunds are made. Return postage for a change of mind is at your own cost. Return costs for faulty goods are covered by us.

11. Our Liability

Nothing in these Terms limits or excludes our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be excluded under UK law

Subject to the above, our total liability to you in connection with any order shall not exceed the price paid for the goods in that order.

We are not liable for losses that were not foreseeable when the contract was formed, or for any business losses (for example loss of profit, data, or goodwill).

12. Privacy and Data Protection

Your personal data is processed in accordance with our Privacy Policy and applicable data protection laws (including UK GDPR).

13. Intellectual Property

All trademarks, logos, and brand names on the Website (including "Smart Monkey Golf") belong to us or our licensors. The design of our stance mirrors is patent pending. You may not use our trademarks or designs without our prior written consent.

14. Events Beyond Our Control

We are not liable for delays or failures caused by events outside our reasonable control (for example strikes, pandemics, extreme weather, or supplier failures). If such an event delays your order, we will tell you, and you may cancel for a refund of anything you have paid for goods not yet received.

15. General

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full effect.

These Terms are governed by the laws of England and Wales. Any disputes are subject to the non-exclusive jurisdiction of the English courts. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
